Lesson: Short-Term Rental Rules in Australia – What to Check Before You List

Introduction

In short

Before listing a short-term rental in Australia, check your state’s rules (such as registers, day limits or levies), your council’s requirements, any strata by-laws, landlord consent if you rent, insurance that covers paying guests, your tax obligations and fire safety requirements. Rules differ by state and council and change often, so use official sources and get professional advice.

Questions people ask

Do I need to register my Airbnb in NSW?

NSW requires most short-term rental properties to be registered on the state register before they are advertised. Check the NSW Planning website for the current requirements.

Is there a limit on Airbnb nights in Sydney?

NSW limits non-hosted short-term rentals to a set number of days a year in Greater Sydney and some other areas, while hosted stays aren’t capped. Check the current rules, as they are under review.

Does home insurance cover Airbnb guests?

Not always. Many standard home and landlord policies don’t cover short-term letting, so ask your insurer in writing and check whether liability cover applies.
