Reading it as a short-stay buyer
  • Rental vacancy under 1% means a strong long-term rental fallback if you ever stop short-stay letting.
  • A low owner-occupier share and lots of new approvals can mean more competing rentals. Check both.
  • Days on market shows how quickly you could sell. Fewer days means an easier exit.

Long-term rent is your fallback

A 3-bedroom house in Byron rents for $37,700 to $97,500 a year long term, depending on the suburb. A short stay only makes sense if it clears that comfortably after cleaning, platform and management costs, which is why we test both before you buy.

Byron short-stay rules for buyers

Taken from the same verified council audit as our Byron management page. Open a question for the detail and the official source.

YESIs there a day cap on non-hosted Airbnb stays in Byron Shire?

Yes. Since 23 September 2024, non-hosted short-term rental accommodation is capped at 60 days in a 365-day period across most of Byron Shire, down from the previous 180 days. New registrations were covered from that date, and existing registrations moved to the 60-day cap at their first renewal on or after it. Suburbs such as Suffolk Park, Sunrise, Ewingsdale, Bangalow, Mullumbimby and the parts of Byron Bay outside the mapped precinct fall under the 60-day cap. Wealth Through Property checks a buyer's exact address against the state maps before any income is modelled on more than 60 non-hosted nights.

CHECKWhich parts of Byron Shire still allow non-hosted stays all year?

Only two mapped precincts are exempt from the 60-day cap and allow non-hosted stays up to 365 days a year: one in and around the Byron Bay town centre, and one at Brunswick Heads. Byron Shire Council says these areas are shown in pink on its maps, and the boundaries are set in the Housing SEPP, so a street name or suburb alone does not tell you whether a property is inside. Wealth Through Property checks the specific lot against the mapped precinct boundary before a buyer pays a premium for year-round letting.

NODo hosted stays or long bookings count toward the cap?

No. The day cap applies only to non-hosted stays, where the host does not live on the premises; Byron Shire Council confirms no day cap applies to hosted stays. Bookings of 21 consecutive days or more are also exempt from the non-hosted day limits. Units in a building with an onsite manager or concierge are generally treated as non-hosted. Wealth Through Property checks how a buyer plans to use the property (hosted, non-hosted or mid-term) so the income forecast matches the rules that apply.

Short-term rental accommodation | Planning (NSW Department of Planning) ↗

YESDoes the property need to be registered and meet fire safety rules?

Yes. Every dwelling used for short-term rental must be registered on the NSW STRA Register through the NSW Planning Portal, with a $65 fee for new registrations and a $25 annual renewal. The dwelling must meet the STRA fire safety standard, including an evacuation plan and interconnected smoke alarms, and hosts must follow the mandatory NSW Code of Conduct, including holding third-party liability insurance and telling neighbours and the owners corporation. Wealth Through Property checks the registration history, smoke alarm set-up and any strata by-laws before a buyer commits.

Short-term rental accommodation | Planning (NSW Department of Planning) ↗

CHECKCan any dwelling in Byron Shire be used for Airbnb without council approval?

Not every dwelling. Byron Shire Council says hosted and non-hosted stays are allowed without council approval only where the state standards are met. Secondary dwellings approved under the 2011 to 2019 affordable rental housing rules cannot be used for short-term rental, and boarding houses, seniors housing, caravans and similar dwellings are excluded. Bed and breakfasts, serviced apartments and other tourist accommodation need an approved development application instead of STRA registration, and some strata by-laws prohibit non-hosted letting. Wealth Through Property checks the property's approvals, dwelling type and by-laws before a buyer relies on short-stay income.

Common questions

Buying an Airbnb or investment property in Byron FAQs

Can I run an Airbnb in Byron Shire?

Yes, but non-hosted stays are capped at 60 days a year across most of the shire. The Byron Bay town centre and Brunswick Heads precincts allow non-hosted stays up to 365 days, hosted stays have no cap, and bookings of 21 days or more don't count toward the cap. Every home must be on the NSW STRA Register.

What are the best Byron Shire suburbs for an Airbnb investment?

It depends on the cap. Properties inside the Byron Bay town centre and Brunswick Heads precincts can be let without a host all year. Brunswick Heads 3-bedroom houses sold at a median $1,635,000 and Byron Bay 3-bedroom houses at $1,600,000. Outside the precincts, Mullumbimby ($1,120,000) and Ocean Shores ($1,200,000) 3-bedroom houses suit buyers who plan hosted or long-term use.

What does an Airbnb earn in Byron Shire?

We don't publish a nightly rate or annual Airbnb income for Byron Shire here because we have no sourced figure we can stand behind. Before you buy, WTP prepares a property-specific estimate from current comparable listings and the local rules. Outside the precincts, any estimate has to allow for the 60-day non-hosted cap.

Does a buyer's agent need a licence in NSW?

Yes. In NSW a buyer's agent must hold the right real estate licence. WTP is a licensed buyer's agent in Queensland and New South Wales, so we can act for you directly here in NSW. In other states we work through licensed partner agents.

What are WTP's buyer's agent fees?

Our current buyer's agent fees are listed on the Wealth Through Property website, and we confirm the fee in writing before you engage us. We do not quote fees we have not agreed with you.

What if I rent it long term instead?

Median weekly rents for 3-bedroom houses were $1,200 in Byron Bay and Suffolk Park, $950 in Mullumbimby and $930 in Ocean Shores. House vacancy was 1.0% in Byron Bay and 0.7% in Mullumbimby.
